West Virginia Department of Education – Office of Special Education
Purpose
To improve results for children and youth, primarily through leadership and financial support to local education agencies. The West Virginia Department of Education, Office of Special Programs (OSP) has a responsibility, under federal statute and regulations, to have a system of general supervision that monitors the implementation of the Individuals with Disabilities Education Improvement Act of 2004 (IDEA) by local education agencies (LEAs).
The system is accountable for enforcing the requirements and for ensuring continuous improvement. As stated in Section 616 of the 2004 amendments to IDEA,”The primary focus of Federal and State monitoring activities are to improve educational results and functional outcomes for all children with disabilities and ensure that States meet the program requirements under this part, with a particular emphasis on those requirements that are closely related to improving educational results for children with disabilities. In addition, West Virginia Code ยง18-20-1 (Education of Exceptional Children) requires WVDE to assure that all exceptional students receive an education in accordance with state and federal laws and regulations.
